Sometimes the areas of employment and criminal law overlap. Having spent over 30 years investigating / defending criminal cases, Phil has experience like few others when it comes to an overlap in these jurisdictions. Just check his references for evidence from previous clients who have found themselves in the most difficult of circumstances. He has dealt with many such cases and has achieved good results for his clients as a result. Sometimes it’s to prove the employee is innocent; other times, it’s a damage-limitation exercise; but it’s always a good idea to contact Phil for a chat prior to meeting anyone, saying anything, or signing anything.
If you have been accused of criminal behaviour in the context of the workplace, call Phil for an obligation free consultation.
Likewise, if you are an employer and you suspect a staff member (or members) of criminal activity – either at work or outside of work, and you want to know how to best proceed, call Phil.
I would have no hesitation in recommending Phil Mitchell to potential clients.
I was impressed from the moment that I called his firm and he personally answered the phone and listened to the brief.
There were no delays once initial contact was made and we met, and committed to a plan of action.
Response times were immediate throughout the process as negotiations went back and forth; and Phil kept everything unemotional and professional at all times.
The no fuss completion of dealing between employer and employee was exceptional and it is without hesitation, I would recommend Phil and his law practice.
I approached Phil for urgent advice on an employment matter – I had recently (and unexpectedly!) been advised that my Senior Executive role was being restructured. Phil made time to meet with me as soon as possible and provided excellent strategic advice on what course of action to take. Once we agreed on the approach, Phil kept me up to date, and he negotiated a fantastic outcome. Phil provided outstanding advice and support, I would have no hesitation in recommending his services.
I engaged Phil as my lawyer at a time when my workplace had become untenable for me to continue working there. I’d never gone to a lawyer for a work related issue before and was very unsure what options I would even have for exiting my work. Phil made time to see me within a couple of days and the initial meeting was over an hour long. Phil listened and was easy to talk to, he suggested a way forward and possible options that I could take in plain language that I understood. I found Phil was always available to talk or answer my emails, and always contacted me to discuss any new development, his reliability on communication was important for me to feel I had somebody advocating for me.
At a point where there were added complications at my work and I found making a decision difficult, Phil was patient and practical, suggesting I take the weekend to think on things before reaching any decision. The eventual outcome and settlement was exactly what I needed to move on, not just financially but to feel I had some kind of justice in having my voice
heard. I am very grateful to Phil, even just telling him my story was a huge weight off my shoulders. I would highly recommend Phil to anybody who finds themselves in need of some practical legal advice.
I would highly recommend Phil Mitchell for your employment related matter. Phil provided me with excellent legal advice, knowledge and expertise. My employment situation was complex and my work environment was layered with ongoing behavioural issues that were having an impact on my wellbeing and sense of self worth.
It is easy to feel vulnerable when your employment is threatened and Phil understands this. He is a perceptive listener who will attend to your matter with intelligence, honesty and integrity.
Phil not only provided his legal expertise for an excellent mediation outcome, but also provided support in a genuine and thoughtful way.
Phil is the kind of guy you want in your corner!
I was unfairly dismissed from my position from a major NZ corporate and Phil’s confidence in the strength of my case encouraged me to pursue the case. His communication was excellent and he provided reassurance during an uncertain time. The way he presented my case made the opposition speechless. Phil is an outstanding lawyer, his level of preparation and attention to detail helped successfully solve my case. I highly recommend Phil.
Phil helped me through a crucial time in my employment situation. I came to him for assistance and advice with my employment issue, unsure what to do. He expertly laid out what options I had and how to proceed with these. Once I made my decision, he very efficiently and professionally wrapped up my situation and I was able to have a sense of relief I hadn’t felt in awhile. I would definitely recommend Phil as an employment lawyer.
I was in a senior legal role with a large organisation. I came to see Phil when the relationship between myself and my employer became complex as a consequence of different expectations of what the role entailed. I instructed Phil to accompany me to a meeting to explore the possibility of resolving the conflict.
I instructed Phil at very short notice. Phil made himself available, identified the issues quickly and gave me advice that was direct and constructive. This immediately put me at ease and made me feel that I was in very safe hands.
Phil took the time to explain the process to me and to answer all of my questions in simple and direct language which was so important given how stressed I was having never been in this kind of situation before. Phil’s approach at the meeting was calm, professional and courteous.
Throughout the meeting Phil advocated strongly for me whilst never allowing the situation to become combative or personal. Phil proposed and secured agreement to a constructive solution at the meeting.
After a few days of reflection I decided to resign. Phil negotiated a settlement the following day, secured the agreement in writing the day after, following which the agreement was endorsed by a MBIE mediator the day after that. The entire process from the day I instructed Phil to final resolution took one week.
Phil’s legal advice and support was non-judgmental; Phil was patient and calm which was important during those times that I got the wobbles and wasn’t sure about what to do. Because of Phil’s approach I was able to make a fully informed decision about my future based on legal advice that was straightforward and easy to understand.
The situation for me at the time that I first instructed Phil felt completely overwhelming and unresolvable. Instead the matter was completely resolved within one week. Phil is an effective, confident, professional lawyer and I cannot recommend Phil highly enough.
Phil was personable and approachable. He provided good, common-sense advice that enabled us to resolve our employment problem quickly.
Phil was a rock when I was completely stressed out; he didn’t mind me crying in his office!
Phil has a pragmatic and common-sense approach to employment issues that has certainly helped us resolve staff problems in a quick and effective manner.
I don’t know any other lawyer who answers his phone at the weekend or after hours. Being able to contact Phil when it suited me, was of great assistance.
Friendly, helpful and effective. I was able to move on after Phil quickly sorted my personal grievance against my former employer.
I recently contacted Phil Mitchell to discuss a confusing employment situation on recommendation from a friend. Within half an hour, we had agreed on a course of action and I knew exactly where I stod legally. Phil recommended that I didn’t take legal action in my particular case (which speaks volumes for him as a lawyer) but it was an excellent outcome for me, as I knew all the pros and cons. I would recommend Phil again and wish I had seen him sooner.
Through Phil acting for me I felt I regained my self-respect; it was more important than the money. Because I’ve elected to stay working for my employer they have to respect me going forward. I just wanted to be treated fairly. Phil had the skill and expertise that I didn’t have; he was very frank and honest about the expected outcome. I was very happy with the service I received. I actually felt like an individual with Phil – he took the stress away.
I was in a senior management role at a large Maori charitable trust when we had to deal with a major restructure and a personal grievance brought by one of the managers whose position was dis-established. Phil worked tirelessly in dealing with a very difficult situation. Phil would be my first recommendation to anyone looking for an effective and hard-working employment lawyer.
I recently required the services of an Employment Lawyer due to an unforeseen redundancy. After doing some research I decided to use Phil Mitchell. During the process I found Phil to be professional easy to deal with and he kept me informed throughout the process. He offered sound advice and achieved the desired outcome promptly and without hassle. In the event I know anyone requiring employment law advice I would happily recommend Phil’s services.
Thank you Phil – for the legal stuff but just as importantly for your understanding of the whanau / familial thing – separating it without dismissing their importance to me. Very cool.
I was made redundant from my employer of 25 years. It was totally out of the blue. I’m a solo mum with an 11 year old child and a large mortgage. I was at breakdown point. The company offered me a redundancy payment, but I wasn’t too sure if this amount really represented 25 years of service to the company. I had agreed to have a meeting with the finance director, and to be totally honest I was going in to agree with their offer. A friend of mine who was helping me through this tough time told me not to do anything till I had seen Phil Mitchell, a lawyer she had dealt with in an employment dispute months earlier. I was in such a state that part of me just wanted it over and done with, but at my friend’s insistence I rang and made an appointment that day to see Phil. Well, from that moment on everything changed. I arrived at Phil’s office a complete wreck; he handed me a box of tissues and I slowly told him my story while holding back tears. My first impression was his compassion – he gave me time to compose myself and offered a bit of emotional counseling and positive reinforcement. Phil advised me I was entitled to a better redundancy package. He rang the company, rescheduled the meeting and told my employer that I was in no emotional state to return till the meeting in two days time. Those days gave me time to sit in the sunshine and gain some strength and composure. We arrived at the company and sat with the finance director and an HR woman they had flown from in from Auckland. Phil spoke calmly and right from the start and set the meeting in motion – it was an quite empowering moment for me. Phil discussed with the company in a very professional manner the errors made in their process which opened the door to negotiations. At the end of the meeting they had agreed to a package that doubled the amount first offered to me. Phil picked me up from rock bottom and now I have time to spend with my daughter and be financially sound until the right position becomes available for me. Phil was my hero!
We recently worked with Phil after my husband, a senior executive in a major IT firm, was suddenly sidelined by the company. We had never been in this position before and were quite overcome with the enormity of what happened and the way it was done. We were also overwhelmed with Phil’s support, knowledge and professionalism in what was a very difficult few weeks. We both believe that Phil tuned in, both professionally and personally. He understood it all and actually ‘felt’ all our emotions and it was a huge solace to have him ‘in our corner’. The settlement Phil obtained for us enabled my husband to walk away with his head held high. We would certainly have no hesitation in recommending Phil to others
It’s great to meet a lawyer that while very professional also has a heart and compassion for people going through very stressful situations. After meeting with Phil the stress seemed to instantly melt away. He talked me through the options and helped me make reach a decision regarding my future. I really felt he backed me the whole way. Phil did everything he said he would and kept in touch with me the whole time as the situation with my former employer developed. I would certainly not hesitate to contact Phil if I ever needed a lawyer again and would certainly recommend him to family and friends without hesitation.
I was in a senior role in an international finance company. I made a terrible error of judgment that resulted in a police investigation and serious criminal charges arising. I resigned immediately. I instructed Phil to work on both the criminal and employment law aspects of my case. Phil ultimately negotiated a settlement of the case against me that was before the Employment Relations Authority. Phil also negotiated with the Police at length and had the charge reduced, and ultimately he secured a discharge without conviction and permanent name suppression, (which provided me and my family an opportunity to rebuild our lives). My situation took about 14 months from start to conclusion. Phil supported us the whole way. We developed a great working relationship and Phil was always available to talk and meet – we even met on weekends. Phil, who has a thorough understanding of the law but as importantly how the “system” works day to day, mapped out a strategy for a very complex situation, executed it, and got an amazing result. He was efficient with his time and work in order to keep costs under control as much as possible. Even the sentencing judge said he was impressed with and persuaded by Phil’s arguments. Phil achieved the impossible and I have no hesitation in recommending Phil to anybody in serious trouble who needs a committed lawyer who will focus on their case with compassion and interest.
Thank you so much for all your help. You made a difficult and potentially unpleasant process easy, quick and painless. I was impressed by your intuitive understanding of the issues and professionalway in which you handled the process I am extremely pleased with the outcome and have a sense of peace that I have not felt for some months. I would not hesitate to recommend you to anyone that is looking for an excellent employment lawyer.” Warmest regards
I was a senior manager in a national company. I came to see Phil in early December after becoming the subject of a corporate employment investigation. Phil took over the correspondence between the company and myself which was a huge stress relief for me and my family. My initial desire was to do all i could to keep my job, however, after seeing how the company was handling the investigation I instructed Phil that I felt i could not return to work, and for Phil to negotiate an exit. Phil was able to secure a great settlement at short notice, finalising everything the week before Christmas – he even worked an extra day into his planned leave to ensure everything was finalised before the Christmas break! Throughout the process Phil was available day and night, often responding to emails and txts well after hours. Phil was very clear about what I could expect as a likely outcome from the outset which was a great help. My family and I were able to enjoy the holidays with no immediate stress or pressure financially. Most importantly to me, I was able to resign with a great reference, giving me a true sense of accomplishment. Thank you Phil!
Phil displayed great skill in assisting me with a very complex work issue. He quickly got to grips with the issues maintaining a professional yet pragmatic approach throughout. Would highly recommend him and his services
I had a major issue with a diplomatic mission and was adamant on taking them on but not without some trepidation. The best decision I made in this whole episode was taking on Phil Mitchell as my lawyer. In my opinion, he is the benchmark for lawyers- professional, polite, he listens to what you have to say , he fought hard for me resolutely despite intimidation from the opposing side and at times when I was emotional, he had the experience to guide me through, never losing sight of the goal. He had the experience to know when and how to apply the pressure on them to get the best results for me. Suffice it to say, I am very happy and relieved at the outcome. To top it off, he was always mindful of the costs and worked efficiently to keep them well under control. I cannot recommend him highly enough- if you have employment legal issues- he’s your man.
From the moment I first met Phil I knew he was the right man for the job. Phil was instantly likeable but more importantly with his prior career I knew he would be tough. I was always confident that my employment case was in good hands, he was a good communicator, he always kept me updated, told me the blunt truths and the forthcoming risks which I may be exposing myself to. He always however respected my judgement and did not try and persuade me otherwise. I am extremely thankful to Phil for all his hard work and knowledge and was more than delighted with the outcome I had. I can definitely recommend Phil as an employment lawyer who will always “have your back” Thanks so much Phil you were simply amazing!
I am so grateful for Phil’s support in dealing with an employment issue. I was employed for five years by a health board. I had felt bullied by the employer and Phil was very understanding. From my ase, Phil provided me with clear options which ensured that I remained realistic about what was possible. From this, I was able to instruct Phil in negotiating an exit plan from my employer by means of a personal grievance. We succeeded in this and Phil ensured that my rights were respected by the District Health Board. It was helpful to receive some money and the DHB had to also pay for the legal costs. This has allowed me to have a breathing space for a couple of months and I have made new career plans. Most importantly, Phil’s hard work has helped greatly with my self-esteem and my professional integrity has remained intact.
Thank you so much Phil! You’re amazing and the thing that never changed was your word: you promised you would get results and look after me and you definitely delivered on that. So grateful for all the work you have done & I am also happy to know there are honest and good people like you out there who seek justice for those who are unable to get do it on their own. Thank you once again 🙂
